Decree No. 8741 Creation of a University Institute of Technology at the Lebanese University

First: Special provisions

 

Article 1

 

1- An institute called the “Faculty of Technology” is hereby created within the Lebanese University, with its headquarters located in Saida. The provisions of this decree, based on Article 9 of Law No. 12/81 of May 12, 1981, constitute a special regime specific to the institute, adapted to the requirements of its operation, the conditions and procedures for recruitment, and enabling it to meet the needs of the employment and production sectors, namely:

- Preparing students for technological jobs in these sectors;

- Conducting research and applied studies that meet their needs, in collaboration with these sectors, academic institutions, and research centers in Lebanon and abroad;

- Entering into contracts with the above-mentioned sectors to train and retrain their employees.

- Supervising scientific and educational cooperation in university institutes of technology in France and at the Lebanese University.

2- In the following articles of this decree, the following terms shall have the following meanings:

- “Minister”: the Minister of Culture and Higher Education.

- “Institute”: the University Institute of Technology.

- “Board of Directors”: the Board of Directors of the University Institute of Technology.

- “Scientific Council”: the Scientific Council of the University Institute of Technology.

- “Director”: the Director of the University Institute of Technology.

- “University Council”: the Council of the Lebanese University.

3- The affairs of the Institute shall be managed by a Board of Directors and a Director, assisted by a “Scientific Council.”

 

Second: The Board of Directors

 

Article 2

 

1- The Board of Directors shall be composed of ex officio members and appointed members.

A- The ex officio members are:

- The French Ambassador to Lebanon or his representative.

- The president of the Lebanese University or his representative.

- One of the deans of the Lebanese University appointed by the University Council.

- Three members appointed by the Hariri Foundation.

- A representative of the French Ministry of Higher Education and Research, appointed by the French Minister of Higher Education and Research.

- A representative of the institute's teaching staff, elected by its permanent or full-time contract members for a renewable one-year term.

- A representative of the university institutes of technology in France, appointed by the French Minister of Higher Education and Research.

b- The six appointed members are chosen from among the sectors of labor, production, and development institutions operating in Lebanon, one of whom must be a representative of French economic activities in Lebanon. They are appointed for a renewable three-year term by decision of the minister, after consultation with the university council, which chooses them from a list of twelve names proposed by the statutory members.

2- The members of the board of directors elect a chairperson from among the appointed members, who is responsible for:

- Setting the agenda for the board, chairing its meetings, and leading the discussions;

- Exercising the powers delegated to him or her by the board of directors.

3- The board of directors shall meet, as a general rule, at least once every two months, as well as whenever the need arises, at the request of at least half of its members or at the request of the director, and its quorum shall be reached when at least seven of its members are present.

4- The Board of Directors shall take its decisions by a majority of the members present and, in the event of a tie, the Chairman shall have the casting vote.

5- The director participates in board meetings without the right to vote.

6- The board of directors approves the following regulations, procedures, and projects:

- Proposals from the scientific council, including those specified in paragraph (2) of Article 3 below.

- Contracts for full-time faculty members and those hired to teach on an hourly basis (theoretical courses, tutorials, practical work) and responsible for training.

- The deposit of funds from supplementary budgets in private banks.

- Other matters that do not conflict with the provisions of this decree.

7- The Board of Directors is directly responsible for:

- Appointing faculty members and “Lebanese experts

- members of the scientific council,” in accordance with the provisions of paragraph (c) of Article 3 below, while non-Lebanese members of the scientific council are appointed by the Minister of Culture and Higher Education on the recommendation of the Minister of Higher Education and Research in France.

- Requesting the secondment of faculty members from the Lebanese University to work at the institute.

- Any other matters that do not contravene the provisions of this decree.

8- Decisions that fall within its jurisdiction in accordance with the legal provisions of the university are subject to the approval of the university council.

9- Decisions submitted for approval by the Minister of Culture and Higher Education shall be submitted for his approval in accordance with the legal provisions of the university.

10- The Board of Directors may delegate some of its powers to its chair or to the director of the institute.

 

Third: The Scientific Council

 

Article 3

 

1- The Scientific Council shall be composed of:

a) The director of the institute, who shall be its chair;

b) The heads of the scientific departments, who shall be its members;

c) Members of the teaching staff or experts from outside the institute proposed by the director, as needed, with their number not exceeding four, and appointed as members by the Board of Directors.

d) Three French experts appointed by the Minister of Culture and Higher Education in Lebanon, on the recommendation of the Minister of Higher Education and Research in France, as members.

2- The Scientific Council is responsible for developing the following procedures and regulations and submitting them to the Board of Directors for approval:

- The scientific orientations of the institute, including research;

- The specialties taught at the institute;

- The teaching and training programs, their modification, their implementation and evaluation procedures.

- The distribution of courses over the three years of university education.

- The means of cooperation between the institute and its partners with regard to teaching staff and training issues.

- The names of the members of the teaching staff referred to in Article 5 of this decree.

- The system of entrance examinations to the institute and the system of examinations within it.

- Any other matters that the board of directors entrusts to it for study and on which it is required to give its opinion.

3- The director shall convene the scientific council in meeting whenever the need arises or at the request of the board of directors.

 

Fourth - Director of the Institute

 

Article 4

 

1- The director of the institute shall be appointed for a four-year term, renewable by decree of the Council of Ministers on the recommendation of the minister after consultation with the board of directors and the opinion of the university council. He or she must be a member of the university's teaching staff and hold the rank of professor. When appointing the first director of the institute, it is possible to waive the principle of consultation with the board of directors.

2- The director is responsible for the administrative, technical, academic, and financial management of the institute in accordance with the provisions of this decree and the legal and regulatory provisions in force at the Lebanese University. His or her authority extends to the entire teaching staff, the institute's secretariat, and the students.

 

Fifth: Teaching staff

 

Article 5

 

1- The teaching staff is subject to the provisions of the educational regulations approved by the board of directors on the recommendation of the scientific council, in accordance with the general regulations of the teaching staff of the Lebanese University.

2- The conditions for appointing members of the institute's teaching staff are set in accordance with the same principles as those adopted for determining the conditions for appointment at the university.

3- The university council may second members of the teaching staff to work at the institute, on a full-time or part-time basis, within the scope of their respective duties. This is done on the proposal of the director of the institute, on the recommendation of the scientific council and at the request of the board of directors.

4- The institute may enter into contracts with recognized experts and professionals to take charge of tutorials, practical work, and training carried out by the institute, and they shall receive the same remuneration for each hour worked as that received by faculty members hired on an hourly basis to carry out practical work. This shall be done at the proposal of the director, on the recommendation of the scientific council and after the agreement of the board of directors and the approval of the university council.

5- The board of directors may assign full-time faculty members, in accordance with the provisions of paragraphs 2 and 3 of this article, to perform additional tasks related to preparation, in addition to the quota approved by the institute. The basis for compensation shall be determined by a decision of the board of directors, subject to the approval of the university council and the minister. These tasks shall not exceed 50% of the teacher's workload, and the corresponding remuneration shall not exceed 50% of the minimum salary of the teacher assigned to this task.

6- The hourly remuneration of part-time contract teachers at the institute is set according to the following percentages of the minimum salary of a full-time contract teacher.

- Practical work hour: 2%

- Tutorial hour: 2.75%

- Theoretical course hour: 3.5%

 

Sixth: Entrance examinations, exams, and diplomas

 

Article 6

 

1- The Scientific Council shall establish the rules and conditions for the entrance examination to the institute as well as the examination rules. These two sets of rules shall be implemented by decision of the Board of Directors, on the recommendation of the Director, after approval by the University Council.

2- Students who hold a Lebanese baccalaureate or an officially equivalent diploma are eligible to take the entrance exam and are admitted to the institute after passing this exam.

3- The duration of studies at the institute is three academic years.

4- At the end of their studies, after passing the Institute's exams, students obtain a “University Diploma of Technology” (DUT) (Bac + 3).

 

Seventh: Organization of the institute's administration

 

Article 7

 

1- The director of the institute cooperates, administratively and financially, with a secretariat directly attached to him.

2- The staff of the institute's secretariat is constituted in accordance with the provisions in force and specific to the organization of the secretariats of the university sections of the Lebanese University. Employees shall perform their duties in accordance with the same provisions and shall be subject to the same regulations as those applicable to their category within the Lebanese University.

 

Eighth: Financial provisions

 

Article 8

 

The institute shall have a regular budget and supplementary budgets.

First: the regular budget: its appropriations are constituted and managed in accordance with the following principles:

a) This budget includes appropriations for the institute's annual expenses in a separate chapter within the budget of the Lebanese University.

b) These appropriations are allocated to the same expenditure items as those of the university's faculties and institutes and are spent in accordance with the provisions of its financial regulations.

Second: supplementary budgets: their appropriations are constituted, their revenues are secured, and these appropriations and revenues are managed in accordance with the following principles:

a) These budgets provide for the expenditures of individual projects or groups of projects, implemented in partnership and cooperation with the labor and production sectors, educational and development institutions, as well as state administrations and institutions.

b) These budgets are not subject to the annual budget rule, and the appropriations entered therein are considered commitment appropriations and remain payable until the completion of the project or projects for which the budgets were prepared.

c) These appropriations are spent in accordance with the following principles:

- The board of directors is responsible for contracting expenditures.

- The head of the administrative accounting department of the institute's secretariat shall carry out the settlement.

- The university's expenditure controller verifies the settlement of the supplementary budget expenditures.

- The director orders the payment of these expenditures and settles them by means of checks drawn on the institute's account with the Bank of Lebanon or private banks, which he signs jointly with the institute's secretary general.

 The director must draw up a list of tasks for the employees of the institute's general secretariat, specifying each person's administrative and financial tasks and how they are to be carried out.

d) The revenues of the supplementary budgets shall consist of:

- Appropriations allocated in the budget of the Lebanese University to the projects referred to in point (a) of the second paragraph of Article 8;

- Contributions from the Hariri Foundation;

- Contributions from the French government;

- Contributions from institutions in the labor and production sectors, educational and development institutions, administrations, and public institutions.

- Donations, contributions, and bequests intended for the institute. These revenues shall be deposited with the Bank of Lebanon in a special account in the name of the University Institute of Technology - Saida, or in private banks by decision of the board of directors subject to the approval of the minister.

 

Article 9

 

This decree shall be published in the Official Gazette, communicated where necessary, and shall enter into force upon its publication.
